Dear Jeff,
Further to our conversation today I can confirm that the current application for a 2 storey side extension has been found to be the wrong description for the development as the extension is the means to provide 3 self-contained flats in a building currently in use as a 5 person (small HMO). We also found the original design of the side extension to be unacceptable.
You have submitted amended plans and while these (received on 11/2/16) slightly over come concerns (the flat roof rear needs to be designed out) for appearance the internal arrangements are unchanged. Therefore you have been advised that the application will be refused today for failing to provide any response to the policy requirements for such conversions – the fee paid is also insufficient for this type of application.
You assured me that you understood the council’s concerns and that the current application would be withdrawn by this evening. You advised that your client has instructed you to submit a new planning application, this time for the conversion and the extension.
As this next application will be very different in character and description from the current one it will not benefit from being “a free go” so the fee payable is £1,155.
Before submitting you need to be aware of the Residential Conversions SPD and other relevant policies and documents and it would be helpful if you could prepare a brief statement to demonstrate how the application meets these policies. The proposal for 3 new flats will also trigger consideration under policy DM6 for affordable housing. We also discussed amending the last set of plans to resolve the clumsy flat roof to the rear of the side extension.
My point is this: please do not simply resubmit with a new description and fee – you need to do more work after which your client might decide to change his plans.
If you need advice on whether the new proposal would be acceptable in policy terms then you are aware of our pre-application service.
I look forward to hearing from you later today.
