Further to our conversation, I
can confirm that (as detailed on the application form) the premises has been
empty since the start of September 2015, almost a year now.

Whilst you may disagree, the council’s position is that the care
home (C2) is a community use. Therefore, in addition to other reasons you have
provided as to why the existing use can be lost, please provide vacancy period
of the property as a C2 use to progress determination of the application.

I disagree that policy CS31 is
relevant. The policy refers to community facilities but is not specific
about what constitutes a community facility.
By pure definition, if it is a
community facility, it must be available for and provide a day to day service
for that community. In this case, when the property was in
operation, the property provided five bedroom for use as a children’s care
home. This was run by a bespoke provider who subsequently outgrew the site and
moved on. It’s loss would be no loss to the community in its existing use.
The property, in a residential
area, is not suitable for a general care home. It is over 4 floors with
small rooms on each floor. It worked for the previous occupiers but would
not work generally. Therefore, as CS31 is not relevant, there is no need
to prove marketing details.

Please
provide the vacancy period and any marketing details for the C2 use on the
above site in order to justify the loss of a care home that is a community use
(Core Strategy Policy CS31). I have now received positive comments from the
Transport Officer. Thanks.
