Dear Ian
I have now had the opportunity to discuss the recommended
contamination conditions with my line manager. The submitted Desk Study does
not confirm whether the site is contaminated or not. In accordance with the
General Permitted Development Order, prior approval will be refused if the site
is contaminated. In such instances conditions could only be imposed in respect
of mitigation measures put forward as part of the application that demonstrates
that the site would be made safe/acceptable for residential use. The submitted
Desk Study that only assessed the risk of contamination on the basis of the
current commercial use is therefore considered to provide insufficient
information to allow for the determination of the application under the prior
approval process, and let alone the grant of prior approval.
You are therefore advised to either withdraw the application and
resubmit with sufficient contamination details or let the application be
determined as submitted.

Dear
Ian
Please
find attached the recommended conditions on noise and contamination on the
above site. The Environmental Health officer has pointed out that the submitted
desk study environmental assessment has only assessed the risk of contamination
on the basis of the current commercial use and also has not acknowledged the
presence of the landfill site nearby. As such the conditions are
required. A decision is expected by week ending 7/04/2017.
