Dear Daniel,

Thank you very much for your email.

As discussed and agreed last week, in regard to the introduction of a studio flat at ground level, please consider this email as a short statement that briefly summarises the proposed Noise mitigation measures.

Air Quality & Noise Impact, Noise Mitigation Measures

As stated at your email further below, and reference the Air Quality, occupation of this unit is to be reliant on opening the windows for ventilation. However, to mitigate any possible noise issues from the parking near by we intent on using a MVHR system with fresh air provision from roof level. We would also like to highlight that, in reference to acoustics, the proposed studio will be compliant to Building Regulations.

Please also note that, in parallel to the above, the proposed studio is to the rear of London Road, a very quite area, in close proximity to a parking of maximum 8 spaces which is almost never in full capacity.

Following the above description, as discussed and agreed last week and considering that we have proceeded with the Planning Application submission on the 6th of April 2017, we would be grateful if you could proceed with the Validation of our application today.

I trust the above are to your satisfaction.

Please please free to contact me should you wish to further discuss, I remain at your disposal should you require further information.

With kind regards,

Further to our conversation this morning, as part of the Council’s Validation Checklists & Guidance (December 2016), I note that the application site falls within an Air Quality Management Area. Policy DM19 of the LDF Sites and Detailed Policies Document 2012 states that: Where a development would introduce sensitive uses (including residential) into, or intensify such uses within, an Air Quality Management Area, detrimental effects on that use will be mitigated. Mitigation measures should be detailed in any planning application.

Similarly, planning applications for noise sensitive uses in the vicinity of existing noise generating uses, classified roads, railways or in areas with an existing noisy environment such as the city centre should be accompanied by a statement that outlines the existing noise environment and the noise sources likely to affect the development, together with any mitigation measures.

Since the property has been converted into serviced apartments with retrospective permission granted in 2009, full statements on Air Quality and Noise Impact are not necessary in this instance. However, the introduction of a studio flat on the ground floor within part of the existing reception area facing the car park at the rear of the building raises the issue of air quality in a polluted environment. If occupation of this unit were to be reliant on opening the windows for ventilation there could also be an issue of noise.

I intend to consult the Council’s Environmental Health Officer with some information in this regard and in order to make the application valid therefore I need a short statement that briefly summarises the proposed mitigation measures, as you described them to me. If the specifications for these are already known (such as mechanical ventilation) please forward any information you have at this stage but as these matters are usually subject to Building Regulations approval at a later stage the details can be made the subject of a condition attached to any planning permission granted.

I also propose to slightly amend the description of the development as follows:

Internal alterations to including division of 3no. existing three bedroom serviced apartments (Use Class C1) into 6no. one bedroom service apartments; reconfiguration of ground floor reception and laundry room to create additional studio apartment and addition of a lift.

Please confirm that this is acceptable.
