Hello Ralph,
Thanks for your
mail, I confirm the instruction for the application to be withdrawn. I'll
put together a planning application for submission shortly.
A quick query
on the content of the planning application - to give some background
information, the house is in the process of being sold and the requirement to
obtain consent to convert the house back into a single dwelling is entirely for
the comfort of the prospective purchaser, as that's their intention should the
sale proceed.
On the proviso
that the conversion works will consist entirely of internal alterations and no
changes to the exterior, is it necessary for the planning application to
include existing and proposed floor plans and elevations, or can the site plan
and location plan drawing be sufficient to secure the necessary change of use
element.
Look forward to
hearing from you at your earliest convenience.
Regards
Tony

Dear Tony
As
discussed in our telephone conversation today, the above application will not
be supported as submitted, as the proposed conversion from 3 flats to a single
dwelling is considered to constitute a material change of use that would
require planning permission. This follows advise from the Council’s Legal
Officer who referred to the 2000 High Court decision involving a change of use
of a building containing 7 flats to use as a single dwellinghouse (Richmond
upon Thames L.B v SoS & another 28/3/00), that concluded that local
planning authorities are required to take into consideration planning policies
when considering whether a material change of use has occurred. In this regard
the proposal would need to be considered in accordance with policy CS17
(Protecting the Existing Housing Stock) of the Reading Core Strategy that seeks
to protect the existing housing stock within the borough.
You are
therefore advised to submit a planning application for the proposal. Without
prejudging the outcome of the application, a proposal that would create a large
family dwelling in an Article 4 area dominated by Houses in Multiple Occupation
will be supported.
You now
have the option to withdraw the current application and submit a full
application for the proposal or let the application be determined as submitted.
If you let the application be determined as submitted, the decision would be to
refuse the granting of a Lawful Certificate.
If you opt
to submit a planning application, the earliest a decision could be made is
after the 21 day statutory consultation period from the date the application is
validated. Details on submitting a planning application are available on the
Council’s website.
I hope
this is helpful.
