Subject: RE: 172313FUl - Unit 2 Reading
Trade Centre
Afternoon Ralph,
Thanks for your email. In
relation to the Sequential Test and the precedent set at Unit 1 Reading Trade
Centre (150936)
It considered that in this
instance that the sequential test is passed by virtue of specific
characteristics of the retail development proposed and would be willing to
accept a condition in relation to its ancillary retailing element. In addition
to the adjoining unit, the Supreme Court ruling on 21 March 2012 in the Tesco
Store Limited v Dundee City Council, a case which determined that the basis on
which the sequential test should be applied in situations where a specific
operator is known.
The operator in this case is
Cubico Bathrooms tiles whose business format, carries high stock levels, to
provide an ‘on demand’ supply for customers. Cubico must be located in a trade
park environment due to the nature of their operation and the fact that the
vast majority of their clients are tradespeople who have the option of also
linking trips so as to benefit from products offered by neighbouring premises.
Clearly, the bulky nature of a bathroom supplier means that a large open plan
warehousing is required, with parking being available immediately outside the
unit. An industrial location is the most appropriate location for such a use as
a town centre location would be unsuitable and undesirable. Moreover, the
proposed use would complement the other trade warehouse uses within the
immediate vicinity.
It is considered that the retail
element separately would be disaggregating the business to satisfy the
alternative sites criteria in the sequential test. Cubico Bathrooms
predominantly serve the trade sector, selling bulky goods which are taken away
from the site. As such it is a line of trade not required on a daily basis and
does not generate retail linkages associated with centre locations. The trade
use that would require customers to bring vans and lorries to pick up goods
upon purchase for take away would conflict with other retail uses within town
centre locations. It is therefore less likely to impact on the vitality and
viability of existing centres. On balance, it is our opinion that the
sequential test is passed by virtue of specific characteristics of the
development proposed.
Kind Regards

Patrick
I
should be making my recommendation by end of week. Meanwhile, please provide
information on the sequential test for the out of centre retail use proposed.
You may wish to have a look at the details for approved (150936 available
online) adjoining unit 1 for Top Tiles as it is my opinion that similar
justification would be acceptable. Please do contact me if you would like to
discuss the application.
