Dear Gill
Unless you are proposing some pretty serious installation, it doesn't sound like planning permission would be required as the sort of thing I think you're considering (width restriction, speed bump, and wide gates/planters, at a guess?) would either fall under the general umbrella of enclosures or otherwise be de minimis (ie. minor works not triggering development).
Probably best to keep anything under 1m in height on the private highway
Your closure of the Highway bit is nothing the LPA or Highway Authority have any concerns over, this is your private road.
There may be other design good practice to look into for this sort of thing and I expect there are some obvious suppliers.
This is informal advice only, if you wanted a specific officer determination of what you are proposing, you would need to submit what is known as a CLP (Certificate of Lawful Proposed Development) application to us.
Hopefully the above has been of use.
Regards
Richard

Dear Nathalie

Further to your email find enclosed:

1)  Site block plan outlined in red and location plan requested in your email.

2) To the best of our knowledge and detailed in all our deeds the road was owned by Berkshire Estates Company Ltd in the later part of the 1890's who have long since gone into liquidation, so the ownership of the road is unknown. See enclosed Title Register.

3) With respect to Council introduction of Community Infrastructure Levy under the following we would claim exemption.

Do we have to fill in an exemption form if so which?

Minor development,

With a gross internal area of less than 100 square metres, is generally exempt from the levy.

However, where minor development will result in a whole new dwelling, it will be liable for the levy unless it is built by a ‘self builder’.

Paragraph: 109 Reference ID: 25-109-20140612

Revision date: 12 06 2014

Regarding the impact of this proposal for waste collection vehicles and emergency vehicles accessing Derby Road.

We have contacted and had consultation with RBC Highways Department who have raised no objection to the proposal.

There is no intention to close the road on Monday and Friday bin collection days and the pinch point is wide enough to permit Bin lorry vehicular access.

In addition the emergency services have also been consulted and notified and will be issued with closure dates.

We trust this is satisfactory and sufficient for you to validate the application.

Regards David

Dear Mr Moro

I am the case officer assigned to your recent planning application submission to the Council at the above address. I have considered the submission for the purposes of validating the applications and found it to be invalid. The following information is required prior to the application being valid and thereafter registered (and largely relates to the local government validation requirements):

Planning application 182061

The request to create a pinch point by the addition of 2 timber planting boxes on Derby Road.

Validation list

1.    Plans:

i)            The plans provided do not provide a site block plan with the current site outlined in red at a metric scale of 1:1250 or 1:2500;

ii)           The location plan does not provide an accurate scaled illustration for the pinch point as the red blocks are not drawn to scale;

2.    Ownership certificate:

As per section 1 of the validation requirements, if you are not the owner you must serve notice on the owner in accordance with Article 13 of the DMPO 2015. An article 13 combined ownership certificate is required to confirm who owns land affected by the proposal.

3.    CIL

The Council introduced a Community Infrastructure Levy (CIL) on 1st April 2015. This means that applications determined since then are potentially liable to pay CIL. In order to calculate CIL liability, certain vital information needs to be submitted. On the Planning Portal website there is a form that must be completed (https://www.planningportal.co.uk/site_search/results/?q=CIL+FORM)

Having looked at the information submitted, please could you provide additional information on the impact of this proposal for waste collection vehicles and on emergency vehicles accessing Derby Road as a result of the implementation of a pinch point.

In order to enable the application to hopefully be validated and registered in due course, the above additional information must be submitted (via email direct to me is sufficient – with documents ideally in a pdf format) within 28 days of this email. As such, I look forward to hearing from you as soon as possible and no later than Tuesday 15th January 2019. If you are unable or unwilling to provide further information within 28 days then your submission may be returned to you. The statutory timeframe for the Council to determine the application will only begin once all information to enable validation has been received. As such, the sooner the additional information requested has been received, the sooner the application will be able to be registered with view to being determined thereafter. Once the planning application meets the validation requirements, it does not necessarily comply with requirements for approval.

If you have any questions or queries, please do not hesitate to contact me.

Best wishes,

Nathalie Weekes
