Hi Jody,

Of course, that’s fine. I will extend the decision date on this application to Tuesday 14th July.

If you have any questions in the meantime; just let me know.

Kind regards,

David.

David,

Would we be able to add a couple of weeks to that, say 14th July? In addition to the preliminary survey, the Ecologists anticipate the likely need for an emergence survey if nothing within the building has changed since their last inspection.

This would given time for access for both surveys to be arranged within the Covid-19 guidelines, and for us to receive their report.

Regards

Jody

Hi Jody,

That’s not a problem. Would extending the decision date to Tuesday 30th June be appropriate? If so, please confirm. I would like the updated report at least 1 week before the decision date so it can be reviewed by our Ecology Consultant.

If you have any questions; just let me know.

Kind regards,

David.

David,

Please can we have an extension to allow for the building to be inspected and the updated report issued to you.

Jody

Hi Jody,

I have received feedback on the Bat Survey provided from our Ecology Consultant;

As advised, an updated building inspection is required. With the decision date for this application being tomorrow, there are two ways in which we can proceed:

  1. Receive the refusal decision notice for the application on Wednesday 3rd June based on an appropriate bat survey not being provided. Without the updated survey it cannot be determined within this application the presence or otherwise of protected species, and the extend that they may be affected by the proposed development. As a result, the application fails to comply with:
  1. Withdraw the application if you do not wish to receive the refusal decision notice. If you do wish to withdraw the application, can you confirm this to me via email by 4pm today.
  2. Extend the decision date for the application to allow for a building inspection to be conducted, and the bat survey report updated.

Kind regards,

David.

David,

I have managed to contact the Client, please find attached the report following a full emergence survey undertaken in 2018. As you will note there are recommendations for the installation of bat tiles, which will be included within the proposed re-roofing project.

Please can you confirm this is adequate for the purposes of the Planning Application.

Regards

Jody

Hi Jody,

Apologies, the advice I gave you in my previous email is incorrect. As a bat survey has not been submitted in this application, the application will be refused due to this information not being provided. The condition relates to a Bat Licence being obtained after a bat survey has been approved by the LPA.

In regards to this application there are a couple of options for how we can proceed:

  1. Receive the refusal decision notice for the application on Wednesday 3rd June based on a bat survey not being provided. Without the survey it cannot be determined within this application the presence or otherwise of protected species, and the extend that they may be affected by the proposed development. As a result, the application fails to comply with:
  1. Withdraw the application if you do not wish to receive the refusal decision notice. If you do wish to withdraw the application, can you confirm this to me via email by 4pm today.

Kind regards,

David.

This is an EXTERNAL EMAIL. STOP. THINK before you CLICK links or OPEN attachments.

David,

Yes I can confirm receipt, I do not believe we have a bat survey undertaken or in progress such that a copy of the report could be issued this week. Please therefore include as a condition.

Regards

Jody

Good morning,

I am the case officer for planning application 200538 at 35 Upper Redlands Road.

I have received the following response from our Ecology consultant regarding your application:

  • The building is likely to host roosting bats and to confirm whether this is the case, and if so how bats will be affected by the proposals, a bat survey will need to be carried out. The survey will need to be carried out prior to determination of the application or the application would need to be refused on the grounds that insufficient evidence had been provided to determine the likely impacts of the proposals on bats (which are a protected species and a material consideration in the planning process).
  • Survey Requirements
    • A presence / absence bat survey is normally undertaken in two stages, firstly a preliminary roost assessment, whereby the inside and outside of the building is surveyed for bats and signs of bats. This survey can be undertaken at any time of year.
    • If bats are found or features within the building have the potential to support roosting bats and these will be affected by the proposals, further dusk emergence and or pre-dawn re-entry surveys during the bat active season (i.e. between May and the end of August/ sub optimally until mid-October) would need to be carried out. The applicant would then need to submit the results of the survey(s) along with any associated mitigation strategy prior to determination of the application.
    • Surveys should be carried out by suitably experienced ecologists who are a member of a professional organisation such as the Chartered Institute of Ecology and Environmental Management and / or are licensed or accredited by Natural England to survey bats.

A Bat Survey is required before the works detailed in this application commence. Would you be able to provide a Bat Survey for this application, please? If a Bat Survey is not provided before the decision date (03/06/2020), a condition would be added to any approval stating that no development shall commence on site (including demolition or preparatory works) until a licence for development works affecting bats has been obtained from the Statutory Nature Conservation Organisation (Natural England) and a copy has been submitted to and approved in writing by the Local Planning Authority.

If you have any questions; just let me know.

Kind regards,

David Brett
