Hi Nathalie

Its one of them things with the delay I know the feeling with workloads

I sort of misread the email last week as it had a attachment it was just the original planning with a email from the client  I have copied that for you sorry if some of it you don’t need I just copied it across see below

Our website is www.priestleybakers.co.uk

For unit 2 we will have some baking done onsite but 80% of it will be done at our main bakery in slough

it will  be a little bit of baking though the day

We will be offering a full range of bakery goods i.e bread ,cakes, donuts, sausage rolls pies pastys ,sandwiches mainly for grab and go for retail and corporate events

Hope this is ok if you need any more information or more detail please let me know

Thanks

Mark

Hi Mark,

Thanks for the update. I look forward to understanding what items are outstanding on the lease when you’ve met with your solicitor.

Please do pull together your proposed fit out plans as soon as possible, so we can get these reviewed and approved by the landlord’s team. – Your contractors should be able to pull together plans with a specification of the works they’re undertaking, which detail material and affixing descriptions.

I did communicate Trade City Reading’s use to you on our viewing and any concerns over use really should have been flagged/investigated before instructing solicitors…

Reading’s planning administrators have provided the correct information below regarding the scheme’s planning consent and conditions. And whilst I understand their recommendation to secure such certification, it is logical to conclude that this is just a ‘belt and braces’ approach. Given the scheme has consent for B1 use and this now falls under the new Class E use order, which also incorporates  bakery use, ergo, by default, you will be able to trade as you intend.

As we didn’t agree a subject to planning letting and any applications will delay lease completion, this is likely to frustrate both your target opening schedule and my clients, unless you are happy to complete and formalise these items afterwards, given the relative low risk.

Kind regards,

Dear Mr Priestley

I am the case officer allocated to the above application. I apologise for the delay in updating you in respect of the above application; unfortunately workloads are very high at the moment so we are not able to progress matters as quickly as we would like.

Following our earlier conversation, regarding the above certificate of lawfulness for proposed use as a bakery at Unit 2 Sentinel End, in order for me to make a recommendation, please could you send me:

My records show that unit was originally part of 12 commercial units in flexible use within Classes B1(c) (Industrial process), B2 (Industrial) and B8 (Storage and distribution) from planning application 151944 permitted on 14 April 2016.

B1 (c) use class is now part of Class E (Commercial business and service), including retail usage from 1 September 2020. The recent letter from your landlord may clarify the current use.

I will aim to get a recommendation made at the start of next week if you are able to provide additional information by Monday 8 November.

Best wishes,

Nathalie Weekes

Dear Mark,

The application you will want is ‘Lawful development: Proposed use’. You want confirmation that the use of the property as a bakery is lawful.

Kind regards,

Planning Admin

Thanks for getting back to me so quick

I was told by the landlords we are ok to open a bakery and don’t need any planning because of the changes

I was just double checking for myself when the email below mine from yourself said it may be best to get a Certificate of Lawfulness

That’s where I was a bit confused as don’t need to change the planning as already has the use

I just want to make sure 100 percent we are ok

Thanks

Mark

Dear Mark,

Are you applying for confirmation of what the current use is? If so that is correct.

If you are applying for confirmation that what you are planning to do does not require a full planning application then you need to select ‘Lawful development: Proposed use’ – i.e.    you are proposing to use it as something and what confirmation that is ok without changing the use.

There will be a fee calculator at the end of the application process before you submit it to us.

Kind regards,

Planning Admin

If not correct where do I find this

Thanks

Dear Mark,

We believe that unit 2 is part of a planning permission granted in 2016 ref 151944 for:

12 commercial units to be used flexibly within Classes B1(c), B2 and B8 with ancillary retail sales to accommodate trade counters;

Unit 2 is a trade counter as indicated on the attached plan.

There is a condition in the decision notice (attached) =

A bakery will usually fall under class A1 (retail). However Use class A1 was revoked in September 2020. Class A 1/2/3 were effectively replaced with Use Class E(a,b,c). Use Class B1 Business was also revoked from 1 September 2020. It is effectively replaced with the new Class E(g).

Use Classes B2 and B8 remain valid (see 'Current Use Classes' above).

https://www.planningportal.co.uk/info/200130/common_projects/9/change_of_use

Usually you would be permitted to change between the use classes as they are all one Use Class ‘E’. However in this case it is not completely clear if use outside of the condition is allowed, especially as the use classes have changed and are now more flexible.

We suggest you apply for a ‘Certificate of Lawfulness for proposed development’: https://www.planningportal.co.uk/info/200126/applications/60/consent_types/9 for formal written confirmation that that what you are planning to do does not require a full planning application.

Kind regards,

Planning Admin
